Recent immigration directives indicate a shift in prioritization of noncitizens for enforcement and removal. Scattered reports have further revealed a change in practice in some instances – for example, an increase in ICE arrests at or near courthouses, and targeting of individuals with minimal criminal history, strong ties to the United States, and U.S. citizen children. In light of this new enforcement landscape, this training will focus on how to effectively conduct a risk assessment for clients interested in pursuing family court custody actions. What factors contribute to a client’s risk of exposure to immigration enforcement? How can practitioners effectively conduct an immigration screening and provide a client advice about the risks and benefits of initiating a family court action? What steps can practitioners take to mitigate the risks of enforcement against family law clients?
